PLEASE READ CAREFULLY: This agreement, called the “Qniverse Agreement,” is between you (the individual end user who will receive access under this agreement) and CDAC. The agreement consists of three parts: (a) the terms of this Qniverse Agreement, (b) the Privacy Policy of Qniverse, and (c) the authorizations and related instructions indicated on Qniverse. Qniverse listing the specific Quantum resources you are permitted to use (referred to herein as “Authorization Instructions”). By accepting this Agreement on Qniverse webpages, you agree to (i) accept the terms of this Agreement, (ii) understand that you are entering into a binding legal agreement, and (iii) confirm that you are at least 18 years old. If you are under 14, you may not access the Qniverse Web Application. If you are between 14 and 17 years old, your parent or legal guardian must accept this Agreement for you. By doing so, your parent or legal guardian represents and warrants that they have the legal right to do so, understand that this is a binding legal agreement, and accept these terms on your behalf.
1. General 1.1 Applicability: If your access and use of CDAC Quantum is governed and authorized by the terms of a Governing Contract with CDAC, then the terms of that Governing Contract supersede and apply instead of the terms of this Quantum Accelerator Program Agreement. In the event of a conflict between the terms of the Governing Contract and this Quantum Accelerator Program Agreement, the terms of the Governing Contract shall apply.
2. Licenses 2.1 Ownership: CDAC Quantum is owned by CDAC, including all rights, titles, and interest. 2.2 Intellectual Property: All intellectual property rights and title to pre-existing materials are unaffected by this Agreement. 2.3 License Grant: For the term of this Agreement, CDAC grants You a limited, non-exclusive, non-transferable license to access and use CDAC Quantum for research, education, testing, evaluation, and feedback purposes, all provided by You.
